STATEMENT: AFPI Applauds Supreme Court Decision to Overturn Biden’s Student Loan Bailout

June 30, 2023

WASHINGTON, D.C. – Today, the America First Policy Institute (AFPI) released the following statements after the United States Supreme Court struck down one of the most egregious examples of executive overreach in our Nation's history. In Biden v. Nebraska, in which AFPI submitted an amicus brief, the Court invalidated the Biden Administration’s borrower bailout.

“President Biden’s unconstitutional attempt to force people who didn’t go to college or already paid off their college bills to pay for other people’s loans is unconstitutional, immoral, and would add to our already crippling inflation,” said Brooke Rollins, President and CEO of the America First Policy Institute. “The White House’s plan was grossly unfair and a vast government overreach. Today’s Supreme Court decision is a win for all Americans who wish to avoid further financial destruction and the misuse of government funds at the cost of the working class.”

“The Biden Administration’s decision to transfer more than $400 billion in student loan debt from college-educated Americans to hard-working taxpayers without congressional authorization was not just terrible policy, but it also obliterated the constitutional principle of the separation of powers,” said Jonathan Pidluzny, Ph.D., Director of the Higher Education Reform Initiative at the America First Policy Institute. "Today the Supreme Court sent a stern warning to this and future administrations — the imperial presidency is over. No more legislating from the White House.”
