America First Condemns Biden-Harris Push to Ignore Constitution, Pack the Supreme Court

WASHINGTON, D.C – Today, the America First Policy Institute (AFPI) released the following statement from Former Acting Attorney General and Co-Chair of the Center for Law and Justice Matt Whitaker following the Biden-Harris Administration’s calls to unconstitutionally change the structure of the Supreme Court.

“This administration’s push to stack the Supreme Court and dismantle presidential immunity reveals a startling hypocrisy, especially considering President Joe Biden's own past criticism of court-packing. Just years ago, Biden referred to President Roosevelt's proposal to pack the court as ‘bone-headed.’ Now, he and Vice President Kamala Harris, who claim to be defenders of democracy, show no hesitation in abandoning those principles when rulings don’t align with their agenda. This move is a blatant attempt to reshape the judiciary to fit their partisan goals, undermining the independence and balance our Founders intended for the Court.

Make no mistake. Radical politicians and activists are attempting to transform the Supreme Court by any means necessary, with everything on the table. Their strategy includes various measures that go beyond restoring balance or fixing the Court. Instead, it represents an extensive effort to take control of the Court and diminish its authority.

America’s independent judiciary is the envy of the world and a hallmark of our constitutional system. It is worth the fight to keep it.”
