Supreme Court Upholds Title IX Protections for Women

Washington, D.C. – On Friday, August 16, 2024, the U.S. Supreme Court rejected the Biden Administration’s request to be able to enforce its dangerous new Title IX rule that would allow men to compete in women’s sports and would give men access to women’s locker rooms and dorms. The Biden rule was slated to take effect on August 1, but multiple states filed lawsuits to prevent the rule from going into effect, arguing that the rule violates laws that prohibit males from competing in women’s sports. 

“As the mother of two amazing teenage girls who are athletes, Friday’s Supreme Court decision hits very close to home. Fighting for women and girls, ensuring their rights to privacy and security, and protecting fairness in sports is essential to a fair, free and prosperous America. The Supreme Court’s decision is a great win for the super majority of Americans who believe in the fundamental principles of fairness and the rule of law,” said Brooke Rollins, President and CEO of America First Policy Institute. “The Biden-Harris Administration’s brazen attempt to force this dangerous rule into effect further demonstrates how extreme and out-of-touch its policies are with America. Forcing America’s women to allow men into their dorms, facilities, and playing fields has no basis in law or fact. AFPI continues to fight for policies that ensure America remains free, safe, and fair for all.”

After several lower courts ruled that the rule was unlawful, the Biden Administration asked the Supreme Court to allow it to go into immediate effect. A majority of the justices rejected that request. In its unsigned opinion, the Court stated: “the Government has not provided this Court a sufficient basis” to reverse the lower courts’ decisions that the rule is likely unlawful.

The cases will now continue in the lower courts while the Biden rule is on hold pending a final outcome. Read the Court’s opinion here.
