The Biden-Harris Administration’s Unprecedented Expansion & Abuse of Temporary Protected Status

What is TPS? Temporary Protected Status (TPS) is supposed to be a temporary form of relief for aliens when an ongoing armed conflict, natural disaster, or “extraordinary and temporary conditions” make it unable for them to safely return to their home country. Aliens with TPS are generally not removable and are able to obtain work authorization.

How does TPS work? According to the law, the Department of Homeland Security (DHS) must terminate a TPS designation when the conditions that led to the designation no longer exist. Also, DHS must periodically extend TPS when the conditions that led to the designation persist.

How did the Trump Administration handle TPS? There were 10 countries designated for TPS at the start of the Trump Administration. In accordance with the law, that administration terminated 6 countries’ designations because the conditions no longer existed and extended the TPS designations of 4 countries because the conditions continued to exist.

How is the Biden-Harris Administration handling TPS? The current administration has taken unprecedented steps to expand and abuse TPS as a form of executive amnesty. As a result, the TPS population has dramatically increased from approximately 10,000 to more than 2 million illegal aliens, most of whom entered the country over the last 3.5 years.

Step 1: They restored the TPS designations of the 6 countries terminated by the Trump Administration without providing evidence that conditions met the statutory requirements.

Step 2: They unlawfully began categorically paroling in illegal aliens from countries like Afghanistan, Haiti, Venezuela, and Ukraine.

Step 3: They laundered the parole status, which is temporary and easy to terminate, of these illegal aliens by granting TPS with stated reasons that do not meet the statutory requirements.

Step 4: They unlawfully “redesignated” TPS countries every 18 months, which means they changed the cutoff date for eligibility to cover newly arrived illegal aliens from those countries. This alone has caused the total TPS population to increase by over 1 million illegal aliens.

Step 5: They granted TPS to 6 new countries, again citing reasons that do not appear to meet the statutory requirements for a designation.
