Why We Sent This Letter: Defending Women’s Sports and Privacy
At the America First Policy Institute’s Center for Litigation, we are committed to ensuring that policies protect the rights, safety, and dignity of all Americans—especially young women and girls who compete in sports. That’s why we sent a letter to the Wisconsin Interscholastic Athletic Association (WIAA) on February 28, 2025, regarding its Transgender Student-Athlete Policy in light of President Trump’s Executive Order 14201, “Keeping Men Out of Women’s Sports.”
What This Letter Is About
Our letter to WIAA highlights serious concerns regarding its policy update, which still allows biological males access to female locker rooms, showers, and other private spaces—a clear violation of the intent behind Executive Order 14201.
While WIAA’s new policy correctly bans biological males from competing in girls’ sports, it falls short by permitting these individuals to receive all other benefits applicable to student-athletes, including access to private female spaces. This endangers the privacy and safety of female athletes and contradicts the protections laid out in President Trump’s executive order.
Why This Matters
For years, girls and women in sports have fought for fair competition, equal opportunities, and personal privacy. Yet, policies that allow biological males into their locker rooms, shower areas, and other intimate spaces undermine these hard-fought rights.
✔ Privacy Rights: Forcing female athletes to share private spaces with biological males violates their right to privacy.
✔ Safety Concerns: Such policies increase the risk of harassment, assault, and intimidation.
✔ Unfair Pressure: Young women who voice objections often face social backlash, threats, and consequences from school officials and activist groups.
Our Call to Action
We have urged WIAA to immediately amend its policy to fully comply with Executive Order 14201 by:
✔ Ensuring that biological males do not have access to female locker rooms, showers, and other private spaces.
✔ Protecting female athletes who speak out from retaliation or discrimination.
✔ Upholding the principles of fairness and safety in women’s sports.
What’s Next?
We have invited the WIAA Board of Control to discuss these concerns and implement immediate changes. We will not back down until young women in Wisconsin, and across the country, are protected from policies that violate their rights.
