Workplace and Student Enrollment Act

  1. Short Title This act shall be known and may be cited as the “Workplace and Student Enrollment Act” (the “Act”).
  2. Legislative Declaration
    1. Whereas students have the right to access a free and appropriate public education that meets their unique needs; and
    2. Whereas school assignment by residential address excludes students from accessing a public education that meets their unique needs; and
    3. Whereas parents who work near a school serve and are a critical component of the local community; and
    4. Whereas it is in the best interest of the student to have their parent actively engaged in their education; and
    5. Whereas a parent may be more actively engaged in a school if it is located near their place of work;
    6. Therefore, the Legislature declares it is in the interest of individual students and schools to encourage parents to enroll their children in schools near their place of work.
  3. Definitions
    1.  A “parent” means any person who is the legal guardian of a child who is entitled to receive a free and appropriate public education.
    2.  For the purposes of this act, “near” means within a five-mile radius of the school or educational program.
  4. Workplace and Student Enrollment Act
    1. Parents may enroll their children at a school near their place of employment regardless of the parent’s residential address.
    2. If the child of a parent who is employed nearby is enrolled in the school, then the child may continue to attend the school until the parent enrolls the child in another school.
    3. If the parent’s employment status changes, the child’s enrollment in the school shall continue unless the parent enrolls the child in another school.
