Workplace and Student Enrollment Act

- Short Title This act shall be known and may be cited as the “Workplace and Student Enrollment Act” (the “Act”).
- Legislative Declaration
- Whereas students have the right to access a free and appropriate public education that meets their unique needs; and
- Whereas school assignment by residential address excludes students from accessing a public education that meets their unique needs; and
- Whereas parents who work near a school serve and are a critical component of the local community; and
- Whereas it is in the best interest of the student to have their parent actively engaged in their education; and
- Whereas a parent may be more actively engaged in a school if it is located near their place of work;
- Therefore, the Legislature declares it is in the interest of individual students and schools to encourage parents to enroll their children in schools near their place of work.
- Definitions
- A “parent” means any person who is the legal guardian of a child who is entitled to receive a free and appropriate public education.
- For the purposes of this act, “near” means within a five-mile radius of the school or educational program.
- Workplace and Student Enrollment Act
- Parents may enroll their children at a school near their place of employment regardless of the parent’s residential address.
- If the child of a parent who is employed nearby is enrolled in the school, then the child may continue to attend the school until the parent enrolls the child in another school.
- If the parent’s employment status changes, the child’s enrollment in the school shall continue unless the parent enrolls the child in another school.
