Protecting Title 42 Amicus Brief

WASHINGTON, D.C. – The America First Policy Institute’s Constitutional Litigation Partnership, chaired by Pam Bondi, and the Center for Homeland Security and Immigration, chaired by Chad Wolf, filed a friend-of-the-court brief in the Fifth Circuit Court of Appeals in support of 24 state Attorneys General in their fight to keep the Title 42 expulsion authority in place.
In May 2022, the U.S. District Court for the Western District of Louisiana effectively stopped the Biden Administration from unlawfully terminating Title 42, one of the only remaining immigration restrictions at the U.S. border implemented during the Trump Administration. The Biden Administration then appealed the lower court’s injunction to the Fifth Circuit.
